Success for the BBC but did it act in good faith?

The High Court has ruled that the BBC could impose a cap on the annual increase of pensionable pay under its pension scheme by way of a contractual agreement with its employees. This is, however, subject to the obligation that an employer must act in accordance with the implied term of trust, confidence and good faith in its employees' contracts of employment. The question of whether the BBC acted in accordance with those implied duties will only be heard by the Court if the parties cannot come to an agreement in this regard.
